Terms and Conditions
Contract: Prior to commencing writing on your behalf THE GHOSTWRITER will agree terms with you. THE GHOSTWRITER will issue you with a contract for your signature and otherwise terms will be set out in an email which you will be asked to approve.
Fee: THE GHOSTWRITER will agree a fee with you prior to commencing any work. VAT is payable on such fee.
Payment terms: The agreed fee will be payable upon invoice, in instalments, usually as follows unless agreed otherwise:-
- 50% prior to the commencement of work
- 40% upon delivery of the first part or the first draft, as appropriate, of the written material and
- 10% upon delivery of any revisions (or earlier if no revisions are required).
- THE GHOSTWRITER will not commence work upon the next stage of any writing until payment for the previous stage has been received.
- If THE GHOSTWRITER is obliged to travel more than thirty miles from his home in the performance of his obligations then you will reimburse his costs reasonably incurred in travelling to and from the location (and if THE GHOSTWRITER travels by car then this will be on the basis of 40 pence per mile), meals eaten while away from home and, if THE GHOSTWRITER is obliged to stay overnight, first class hotel accommodation, subject to the provision of receipts, forthwith upon your receipt of THE GHOSTWRITER's VAT invoice for such expenses.
These terms will be set out in more detail in the contract or initial email setting out the terms between us.
Copyright: THE GHOSTWRITER does not retain copyright in any materials written for you. The copyright will be assigned to you upon receipt of final payment.
� Liability: You warrant and agree that any material and information provided by you to me for the purposes of my writing any material for you shall be original to you and shall not infringe any copyright or moral or other right of any person; shall not contain any material that is defamatory to any person or blasphemous or obscene; and that you shall be the sole and unencumbered owner of any material. If any such material should belong to any third party you will be responsible for obtaining satisfactory releases and permissions to use such material and will advise me accordingly. Should you fail to do so you will bear full liability to such third party. Further, you warrant and agree that I shall have no liability in respect of any infringement of copyright, defamation, obscenity or other infringement of any nature contained in the material written for you and you agree to indemnify me against all claims, costs, proceedings, demands, losses, damages, expenses or liabilities whatsoever arising directly or indirectly as a result of any breach by you of these provisions. The provisions of this clause shall be deemed to be incorporated into any writing agreement with THE GHOSTWRITER.
