The Other Writer
Terms and Conditions
Contract: Prior to commencing writing on your behalf The Other Writer will agree terms with you.
Fee: The Other Writer will agree a fee with you prior to commencing any work. VAT is payable on such fee.
Payment terms: The agreed fee will be payable upon invoice, in instalments, as follows:
- 50% prior to the commencement of work
- 40% upon delivery of the first part or the first draft, as appropriate, of the written material and
- 10% upon delivery of any revisions (or earlier if no revisions are required).
- The Other Writer will not commence work upon the next stage of any writing until payment for the previous stage has been received.
- Most commissions are undertaken and completed over the telephone and by email but if the writer is obliged to travel more than thirty miles in the performance of his/her obligations then you will reimburse the costs reasonably incurred in travelling to and from the location. These terms will be set out in more detail in the contract or initial email setting out the terms between us.
Copyright: The Other Writer does not retain copyright in any materials written for you. The copyright will be assigned to you upon receipt of final payment.
Liability: You warrant and agree that any material and information provided by you to The Other Writer for the purposes of writing any material for you shall be original to you and shall not infringe any copyright or moral or other right of any person; shall not contain any material that is defamatory to any person or blasphemous or obscene; and that you shall be the sole and unencumbered owner of any material. If any such material should belong to any third party you will be responsible for obtaining satisfactory releases and permissions to use such material and will advise The Other Writer accordingly. Should you fail to do so you will bear full liability to such third party. Further, you warrant and agree that The Other Writer shall have no liability in respect of any infringement of copyright, defamation, obscenity or other infringement of any nature contained in the material written for you and you agree to indemnify The Other Writer against all claims, costs, proceedings, demands, losses, damages, expenses or liabilities whatsoever arising directly or indirectly as a result of any breach by you of these provisions. The provisions of this clause shall be deemed to be incorporated into any writing agreement with The Other Writer.
